Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Aetherin website, workspace and related services (together, the "Service"), operated by Aetherin ("we", "us", "our"). By creating an account or purchasing credits, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at support@aetherin.net if you suspect unauthorised access.
2. The Service
Aetherin provides a software workspace in which users spend prepaid credits to run AI-assisted tasks such as drafting, summarising, translating and code assistance. The Service is provided on an "as available" basis. We may modify, improve, suspend or discontinue features, and we aim to give reasonable notice of material changes that adversely affect paid users.
Aetherin is an independent service. We are not affiliated with, endorsed by, or sponsored by any third-party AI model provider. Model outputs are probabilistic and may be inaccurate; you are responsible for reviewing outputs before relying on them.
3. Credits
- Credits are a prepaid usage unit, priced at 1 USD = 100 credits unless stated otherwise at checkout.
- Credits are non-transferable, cannot be shared between accounts, and have no cash value.
- Credits do not expire while your account remains active and in good standing.
- Credits consumed for completed tasks are not refundable, including where an output is unsatisfactory.
- We may adjust credit consumption rates for particular features where technically necessary; we will not retroactively change the balance already purchased.
4. Orders, pricing and payment
All prices are listed in US dollars (USD). Payments are processed by Creem, which acts as the merchant of record and legal seller for card transactions. Creem calculates, collects and remits any applicable sales tax, VAT or GST, and issues the invoice or receipt for your purchase. Your card statement will show a charge from Creem.
An order is confirmed when payment is successfully authorised. Credits are added to your account once the payment notification is received, which is normally immediate.
5. Refunds and cancellation
You may request a refund of unused credits within 14 days of purchase by emailing support@aetherin.net with your order reference. Refunds are issued through Creem to the original payment method. Credits that have been consumed are not refundable.
Where mandatory consumer law grants you a right of withdrawal (for example, consumers in the European Economic Area or the United Kingdom), that right applies. By requesting immediate access to digital content, you acknowledge that the withdrawal right may be lost once the digital service has been fully performed.
Nothing in this section limits rights you have under applicable mandatory law, including the right to a remedy where the Service is not provided as described.
6. Acceptable use
You agree not to use the Service to:
- violate any law, regulation or third-party right, including intellectual property and privacy rights;
- generate or distribute sexual content, content involving minors, harassment, hate speech, malware, or instructions for causing harm;
- infringe, misappropriate or circumvent the rights, terms or technical protections of any third party;
- resell, sublicense, share or otherwise provide access to the Service or your account to any third party without our written consent;
- probe, scan or attempt to bypass security, authentication, rate limits or billing controls, or place unreasonable load on the Service;
- use automated means to create accounts, farm credits, or abuse promotions and refunds;
- misrepresent your identity or your affiliation with any person or organisation.
We may investigate suspected abuse and may suspend or terminate accounts, withhold credits obtained through abuse, and report unlawful activity to the appropriate authorities.
7. Intellectual property
You retain ownership of the content you submit. You grant us a limited licence to host, process and transmit that content solely to operate the Service for you. As between you and us, outputs generated for you may be used by you for lawful purposes, subject to any rights of third parties in underlying models and training data. The Aetherin name, interface, and site design remain our property.
8. Availability and support
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, upstream provider outages or events beyond our reasonable control may affect availability. Support is available by email at support@aetherin.net; we aim to respond within two business days.
9. Disclaimer and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. AI-generated outputs are not professional advice.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 3 months preceding the event giving rise to the claim, or (b) 50 USD. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business opportunity.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if your use poses a risk to the Service or other users. Where termination is not due to your breach, we will refund unused credits on a pro-rata basis.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on this page with a new "last updated" date, and where appropriate by email. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator of Aetherin resides, without regard to conflict-of-law rules. Mandatory consumer protections in your country of residence continue to apply. Before pursuing formal proceedings, both parties agree to attempt to resolve disputes in good faith by contacting support@aetherin.net.
